All images are the sole property of Nick Memphis and are protected under US Copyright Law. Clients may not reproduce, sell, edit, crop, or use the images for commercial purposes without written consent. Any unauthorized use is subject to a $500 per image penalty.
Client grants the Photographer the right to use images for promotional purposes unless otherwise agreed in writing. This includes but is not limited to use on social media, website, and marketing materials.
No images will be shared publicly without client consent. Your privacy is respected at all times, especially for sensitive sessions.
A minimum $300 retainer is required to secure your session date and is non-refundable. Pre-paid collections must be paid in full prior to the session date. – For standard à la carte sessions, the remaining balance is due before any products, proofs, or digital files are delivered.
All retainers are non-refundable. If you need to reschedule, please notify us at least 72 hours in advance. One reschedule is permitted without penalty; further rescheduling may require a new retainer. No-shows forfeit all payments made and may not be rescheduled.
Photographer is not liable for circumstances beyond control (e.g., client lateness, weather, equipment failure). Liability for any claim, breach, or damage shall be limited to the amount paid by the client.
Client agrees to trust the Photographer’s vision, editing style, and creative choices. While requests are welcomed, the final product will reflect the Photographer’s brand and style.
Due to the custom nature of photography, all sales are final. No refunds or exchanges will be given on any products or services.
Images are typically delivered within 3-4 weeks unless otherwise specified. Photographer is not responsible for long-term storage of digital files. Clients are encouraged to back up all delivered files. Please purchase your images accordingly.
Travel is subject to additional fees beyond 20 miles from St. Paul, MN. A flat fee of $25 will apply for travel within 21-40 miles. Longer distances will be quoted individually.
Prints, albums, wall art, and merchandise may be added to any session. Not all merchandise is listed online, so feel free to inquire about custom options.
If the Photographer is unable to perform this contract due to illness, emergency, fire, casualty, strike, or causes beyond control, liability is limited to rescheduling or a refund of fees paid. This shall not be a breach of contract.
